Our Terms & Conditions
1.Services
Clients wanting to add and/or subtract pages or services during any
stage of the design process after the initial agreement may do so
at Interweb Sitedesigns discretion, however this may incur additional
charges. The final
payment due will reflect any changes that have been made. We do not
accept liability for any delay or failure to meet our obligations
and/or deadlines under
the agreement that result from events beyond our reasonable control.
This includes (but not limited to) events that are within the control
of third parties such as vendors, contractors and service suppliers.
Interweb Sitedesigns will not design or construct web page(s) containing
an intolerance for race, lifestyle, or
faith, or any that constitutes harassment, defamation, libel, slander,
or promotes the commission of a crime or any unlawful conduct. Interweb
Sitedesigns shall have the right to refuse any client order or do business
with any person or entity without liability and without explanation.
2.Payment
Charges for services provide by us that cost more than £500.00 require
a 50% non-refundable deposit before any work is undertaken, once the
deposit
has been received
we will commence working on your
project. Any services provided by us that cost less than £500.00 will
need to be paid in full before any work is undertaken. The remainder
of any fees shall be paid to Interweb Sitedesigns in full
on the completion
of
any project
we
undertake.
Once full payment
has been received any web site(s) we have been contracted to design
will then be published to the www and released to the client. All
payments
for any work carried out by us must be in pounds sterling. Once work has been undertaken on any project, no refunds are awarded.
3.Link
All web sites designed or re-designed by Interweb-sitedesigns will
contain a discrete link in either image or text form to www.interweb-sitedesigns.com,
displaying that it has been re-/designed by Interweb Sitedesigns.
4.Copyright
All clients retain the copyright to data, files and graphic logos provided
by the client, and grants Interweb Sitedesigns the rights to publish
and use such material in fulfillment of the clients order. All artwork
and graphic logos designed by Interweb Sitedesigns for use on the client’s
web presentation will remain the property of Interweb Sitedesigns; and
at its discretion and under separate agreement, Interweb Sitedesigns
will grant the customer rights to use such material in formats other
than web presentations. Clients must obtain the appropriate permissions
and rights to use any information, files or images that are copyrighted
by a third party and for Interweb Sitedesigns to include such materials
in fulfillment of the clients order. The client agrees to indemnify
and hold harmless Interweb Sitedesigns from any and all claims resulting
from the client's negligence, intentional failure or inability to obtain
proper copyright permissions. Evidence of any permissions may be requested
from the client.
5.Termination of services
(a)Clients must notify us in writing if they wish to terminate any contract
between them and Interweb Sitedesigns. Interweb Sitedesigns do not provide
refunds of any fee's paid for any work which has already been undertaken.
(b)We reserve the right to terminate any contract during any stage
of the design process and thereafter if the client has breached any
of our terms or conditions or in the event of any failed or late payments.
6.Access Issues
(a) If Client’s Web site is to be installed on a third-party server,
Interweb Sitedesigns must be granted the necessary access to the client's
storage directories, and those directories must be accessible via FTP.
Depending on the specific nature of the project, other resources might
also need to be configured on the server.
(b) Client agrees that Interweb Sitedesigns shall have the right to
remove from client’s web site any web pages Interweb Sitedesigns
has designed which upon or following posting fail to adhere to the terms
of these terms and conditions, including violation of any licensing
agreements or failure to pay fees duly assessed.
7.Indemnity.
The client agrees to indemnify and hold harmless Interweb Sitedesigns,
its employees, directors, shareholders, members, officers, agents,
subsidiaries
and affiliates from any and all claims, losses, damages, liabilities
and expenses (including solicitor fees) related to or arising out
of
the services provided by Interweb Site Designs to the client, including
without limitation claims made by third parties (including customers
of the client) related to any false advertising claims, liability claims
for products or services sold by client, claims for patent, copyright
or trademark infringement, claims due to disruption or malfunction
of services provided hereunder, or for any content submitted by
the client,
but excluding those related to the gross negligence or intentional
misconduct of Interweb Sitedesigns
8.Disclaimer
(a)INTERWEB SITEDESIGNS SHALL NOT BE RESPONSIBLE FOR ANY ALTERATIONS,
MODIFICATIONS, DELETIONS AND THE LIKE TO THE CLIENT’S PAGES
FOLLOWING PUBLICATION IF WE HAVE NOT BEEN CONTRACTED TO MAINTAIN
THE SITE. IN
NO EVENT SHALL INTERWEB SITEDESIGNS (OR ITS OWNER, DIRECTORS, OFFICERS,
AGENTS, AFFILIATES AND EMPLOYEES) BE LIABLE FOR ANY WORD OR IMAGE
PRODUCED
FOR THE CLIENT, OR ASSOCIATED WITH THE CLIENT OR THE CLIENT'S BUSINESS.
